1. Introduction
These Terms of Service (“Terms”) form a legally binding agreement between you (“you”, “your”) and SupportedCX (“SupportedCX”, “we”, “us”, “our”), the provider of the SupportedCX website and related services (the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
2. Eligibility & Accounts
- You must be at least 18 years old.
- Accounts must be registered by a human. Automated registrations are prohibited.
- You must provide accurate and complete registration information.
- You are responsible for safeguarding your account credentials.
- You must not maintain more than one free account per legal entity.
3. Acceptable Use
You must not use the Service in any way that:
- Violates any applicable UK law or regulation.
- Breaches the Data Protection Act 2018 or UK GDPR.
- Violates the Privacy and Electronic Communications Regulations 2003 (PECR).
- Infringes intellectual property rights.
- Transmits malicious code, viruses, or harmful software.
- Engages in phishing, fraud, impersonation, or deceptive practices.
- Sends unsolicited marketing communications without lawful basis or consent.
- Promotes discrimination, hate speech, harassment, or unlawful content.
- Attempts to build a competing service using our platform.
We reserve the right to suspend or terminate accounts that breach this section.
4. Marketing & Electronic Communications
You are solely responsible for ensuring that all communications sent using the Service comply with:
- UK GDPR
- Data Protection Act 2018
- Privacy and Electronic Communications Regulations (PECR)
- Any applicable marketing or consumer protection laws
You must:
- Obtain valid consent where required.
- Provide a clear unsubscribe mechanism in marketing messages.
- Promptly honour opt-out and suppression requests.
- Not harvest or scrape personal data without lawful basis.
5. Fees, Billing & Refunds
Paid plans are billed in advance in accordance with our pricing schedule. All fees are exclusive of VAT unless otherwise stated.
You are responsible for paying any applicable VAT or taxes required under UK law.
We offer a 30-day money-back guarantee for first-time subscriptions. Refund requests must be submitted within 30 days of your initial payment.
Except as required under the Consumer Rights Act 2015, fees are non-refundable.
6. Intellectual Property
You retain ownership of content you upload to the Service. You grant us a limited licence to use such content solely for providing the Service.
All rights, title and interest in the Service, including software, branding, and design, remain the exclusive property of SupportedCX.
You may not copy, modify, distribute, reverse engineer or create derivative works of the Service without prior written consent.
7. Suspension & Termination
We may suspend or terminate your account if you materially breach these Terms.
You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the billing period unless otherwise stated.
8. Disclaimer
The Service is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation.
Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Any liability which cannot be excluded under UK law.
9. Limitation of Liability
To the fullest extent permitted by law, SupportedCX shall not be liable for indirect or consequential loss, including loss of profits, revenue, or business opportunity.
Our total aggregate liability arising out of or in connection with the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.
10. Changes to the Service or Terms
We may update these Terms from time to time. Where changes are material, we will provide reasonable notice.
Continued use of the Service constitutes acceptance of the updated Terms.
11. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
